These are the rules of the Balar Partner Program in plain English. They are written to be fair to you and simple to check: commission follows the money, you can see what you have earned, and nothing is hidden in the fine print. If anything here is unclear, ask us before you sign up.
1. Who we are and what this covers
The Balar Partner Program ("the Program") is run by Balar Media Group Pty Ltd (ABN 87 612 749 836) ("Balar", "we", "us"), Level 1, 1024 Ann Street, Fortitude Valley QLD 4000. The Program pays you a commission for introducing businesses that become Balar clients. These terms, together with our Privacy Policy, form the whole agreement between you and Balar for the Program. By submitting the partner sign-up form you accept them.
2. Words with a set meaning
- Partner: you, the person or business accepted into the Program.
- Referral: a business you introduce to Balar under clause 4.
- Referred Client: a Referral that goes on to engage Balar for paid work.
- Qualifying Payment: any amount a Referred Client actually pays Balar for our services during the Commission Period, less GST, less third-party pass-through costs (domain registration, third-party software licences, stock media, advertising spend, payment processing fees) and less any amount later refunded or credited.
- Commission Period: for project work (design, development, copy, SEO campaigns, AI search work, apps and any one-off service), every invoice for that work. For recurring plans (hosting, care plans, SEO or marketing retainers, AI search retainers), the first 12 months of each plan from its start date.
- Second-tier Partner: a Partner who joined the Program through your introduction and names you at sign-up.
- Partner Link: the tracked link and sign-up details we issue to you.
3. Who can join
- Any individual aged 18 or over, or any business, with accurate contact details and a bank account we can pay into. You can be in Australia, New Zealand or elsewhere by agreement with us.
- One partner account per person or business. Accountants, bookkeepers, trades suppliers, printers, photographers, IT providers, consultants and agencies are all welcome to join as a business, and commission is paid to the business.
- We set you up within one business day of your application. We may decline or later close an account at our discretion, for example where a Partner competes directly with Balar, has a history of spam or misleading marketing, or breaches clause 8.
- Balar staff, contractors and their immediate family members cannot be Partners for businesses they work with through Balar.
4. What counts as a Referral
- A business counts as your Referral when it either comes to us through your Partner Link, or you introduce it to us by name (an email or message to us, or the business naming you) before its first enquiry with Balar.
- The business must not already be a Balar client, and must not have had an open enquiry or proposal with Balar in the 12 months before your introduction.
- You cannot refer yourself, your own business, or a business you own or control. The Program pays for introductions to other businesses; your own work with Balar is priced the same as everyone else's.
- If two Partners claim the same business, the first introduction we can verify is the one that counts.
- Attribution lasts 12 months from your introduction. If the business signs with Balar within that time it is your Referred Client for the whole Commission Period, even if the work starts later.
- We tag every Referral to you in our CRM so nothing gets lost, and you can ask us for the status of any Referral at any time.
5. Commission
- Direct referrals: 8% of every Qualifying Payment your Referred Client makes during the Commission Period. On a $5,000 website you earn $400. On a $12,000 eCommerce build you earn $960. On a $600 a month SEO retainer you earn $48 a month for 12 months.
- Recurring plans: 8% of the monthly fee for the first 12 months of each hosting plan, care plan or retainer a Referred Client takes, on top of any project commission.
- Second tier: 2% of every Qualifying Payment made by the Referred Clients of your Second-tier Partners, for the same Commission Period. On a $5,000 website your Second-tier Partner earns $400 and you earn $100. The 2% is paid by Balar and never comes out of the other Partner's 8%.
- There is no minimum and no cap. One referral a year or one a week earns the same rate.
- Commission is earned when Balar receives the payment, not when an invoice is issued or a proposal is signed.
- Referred Clients pay Balar's standard prices. Commission is not a discount and cannot be passed on to the client as one unless we agree in writing first.
6. When and how we pay
- Commission is calculated on Qualifying Payments received in each calendar month and paid on the 15th of the following month, by bank transfer to the account you nominate. If the 15th falls on a weekend or a Queensland public holiday, we pay on the next business day.
- You receive a statement each month listing every Qualifying Payment, the commission on it and the total paid.
- If you have an ABN and are registered for GST, you invoice Balar for your commission plus GST, or, if you agree, Balar issues a recipient created tax invoice (RCTI) on your behalf each month. Under an RCTI arrangement you agree that Balar will issue the tax invoices for your commission, you will not issue your own tax invoices for those amounts, and you will tell us straight away if you stop being registered for GST. Either of us can end the RCTI arrangement with written notice.
- If you have an ABN but are not registered for GST, you invoice Balar for the commission amount without GST, or we issue a recipient created invoice for you.
- If you do not have an ABN, we still pay you. We issue a payment summary for the amount and you are responsible for declaring it. Where the law requires us to withhold tax on payments to a payee without an ABN, we will do so and show it on your statement.
- You are responsible for your own tax and superannuation. Partners paid to an overseas account are paid in Australian dollars and bear their bank's receiving fees.
- Commission is paid only to the Partner named on the account. We cannot split a payment between people or pay a third party.
7. Refunds and reversals
- Commission follows the money. If a Referred Client is refunded, in full or in part, within 30 days of making a payment, the commission on the refunded amount is reversed.
- A reversal is deducted from your next payout. If there is no later payout, we will ask you to repay it within 30 days.
- Nothing is ever clawed back from a job the client kept. Refunds after 30 days, credits we choose to give a client for service reasons, and bad debts we write off do not affect commission already paid.
- Chargebacks and disputed payments are treated as unpaid until they are resolved in Balar's favour.
8. How you may promote Balar
- Recommend us honestly, in your own words, to people you actually know or deal with. Say what our website says and no more: we do not guarantee rankings, revenue or timelines beyond what is in a client's signed proposal.
- You may use your Partner Link, the Balar name and logo, and any assets we provide, as supplied and unaltered. You may not register domains, social handles or business names containing "Balar".
- No spam. You must comply with the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth), the Australian Consumer Law and any equivalent laws where you operate. No bulk or unsolicited email, SMS, calls or direct messages promoting Balar, and no purchased contact lists.
- No paid search or social advertising on Balar brand terms ("Balar", "Balar Media Group", our domain), no coupon or deal sites, no forced clicks, cookie stuffing or incentives for people to click your link, and no rewarding a business for enquiring.
- Do not present yourself as a Balar employee or agent, sell Balar services yourself, quote prices or make commitments for us, or run your own "Balar" website or landing page.
- No fake reviews, testimonials or case studies, and no misleading claims about Balar, its clients or competitors.
- If a Referral is generated in breach of this clause we may decline the Referral, withhold commission on it, pause your account, or end your participation under clause 13.
9. What Balar does
- Sets you up within one business day: your Partner Link, your dashboard and the payout details above.
- Tags your Referrals to you in our CRM, treats them exactly as we treat every other prospect, and gives them our standard service, starting with the free homepage concept, at standard prices.
- Decides in its own discretion which work it takes on, how it scopes and prices that work, and how it services the client. Balar's relationship with a Referred Client is between Balar and that client.
- Pays you accurately and on time, and answers any question about a Referral or a statement within two business days.
10. Privacy and confidentiality
- Only pass us a person's details if you have their permission to do so. Personal information you give us is handled under our Privacy Policy.
- Information about Referred Clients, including their projects, pricing, payments and communications with Balar, is confidential. Your monthly statement shows only what you need to check your commission: the client, the amount they paid and the commission on it.
- You must keep confidential anything we share with you about Balar's business, pricing or clients, and use it only for the Program.
11. The relationship
You are an independent referrer, not an employee, agent, contractor for hire, joint venturer or legal partner of Balar. You have no authority to bind Balar or to speak on its behalf. Each of us pays our own costs of taking part in the Program.
12. Changes to the Program
- We may change these terms, the commission rates or the Program itself by emailing you at least 30 days before the change takes effect and updating this page.
- Changes never apply to commission already paid. A Referred Client you introduced before a rate change keeps the rate that applied when you introduced them, for their whole Commission Period.
- If you do not accept a change you can leave under clause 13 and everything you have earned is still paid.
13. Ending your participation
- You can leave at any time by emailing info@balarmediagroup.com.au. We can end the Program, or your part in it, on 14 days' written notice.
- If you leave, or we end the Program or your participation other than for breach, we keep paying commission on Qualifying Payments from Referred Clients you had already introduced for the rest of their Commission Period, up to 12 months after the end date, on the normal monthly cycle.
- If we end your participation for a breach of clause 8, or for fraud or dishonesty, commission not yet paid on the Referrals involved is forfeited. Commission on legitimate Referrals already earned is still paid.
- On ending, stop using your Partner Link, the Balar name and our assets.
14. Liability
- The commission described in clause 5 is the only amount Balar owes you under the Program.
- To the extent the law allows, neither of us is liable to the other for indirect or consequential loss, lost profit or lost opportunity arising from the Program. Nothing in these terms limits rights you have under the Australian Consumer Law that cannot be excluded.
- You are responsible for your own conduct in promoting Balar and will cover any loss Balar suffers because you breached clause 8 or the law.
15. Governing law
These terms are governed by the laws of Queensland, Australia. If there is a disagreement we will talk first and try to resolve it within 30 days; failing that, the courts of Queensland have jurisdiction.
